Virginia: 4473 transfer, no Form 4, no tax stamp, no wait
Virginia repealed its old state registration offense (Va. Code §18.2-308.6), so state law does not add a registration condition. That means in Virginia you can buy a suppressor from JCM Armory, fill out a Form 4473 at your FFL, pass the NICS check and take it home under ATF’s current policy (since October 9, 2026). A voluntary $0 Form 4 is still available if you want federal paperwork on file. Shop suppressors →
Virginia is one of JCM Armory's closest markets, just down I-95 from our Joppa, Maryland shop. Order a silencer online and pick it up at a Virginia FFL near you.
Are silencers legal in Virginia?
Yes. Virginia's only silencer-specific possession statute, Va. Code §18.2-308.6, which made it a felony to possess a silencer not registered in the National Firearms Registration and Transfer Record, was repealed in 2009 (Acts 2009, c. 288). Federal law still applies.
Can you hunt with a silencer in Virginia?
Virginia's hunting firearm statute (Va. Code §29.1-519) and the DWR's legal-use-of-firearms page do not list suppressors as prohibited. Check DWR regulations and any local firearm ordinances for where you hunt.
What Virginia buyers should know
With the old state registration crime repealed, Virginia law doesn't add a registration condition, so the walk-out option is available under ATF's current policy. A voluntary $0 Form 4 is still a good idea if you travel to states that tie ownership to registration.
How buying a silencer from JCM Armory works
Since October 9, 2026, ATF does not enforce Form 4 approval or registration for suppressors. At JCM you pick one of two options (full details in our How to Buy a Silencer Online guide):
- Option 1: Walk out on a Form 4473 + NICS. Fill out the 4473 at your Virginia FFL, pass the background check and take it home. This relies on ATF’s current enforcement policy, which could change.
- Option 2: File a voluntary $0 Form 4 through JCM. We file the ATF Form 4 with the $0 tax option so your suppressor is registered in the National Firearms Registration and Transfer Record. You wait for ATF processing, but you have federal paperwork on file.
