Texas: 4473 transfer, no Form 4, no tax stamp, no wait
Texas Penal Code §46.05 does not list suppressors as prohibited weapons, and Texas law does not tie possession to federal registration. That means in Texas you can buy a suppressor from JCM Armory, fill out a Form 4473 at your FFL, pass the NICS check and take it home under ATF’s current policy (since October 9, 2026). A voluntary $0 Form 4 is still available if you want federal paperwork on file. Shop suppressors →
Texas is one of the most suppressor-friendly states in the country. Whether you're hog hunting in the Hill Country or running a rimfire can at the ranch, you can order a silencer from JCM Armory and pick it up at a Texas FFL near you.
Are silencers legal in Texas?
Yes. Silencers are not on the list of prohibited weapons in Texas Penal Code §46.05; the Legislature removed them, and the old Penal Code definition of "firearm silencer" (§46.01(4)) was repealed by H.B. 957 in 2021. Federal law still applies on top of state law.
Can you hunt with a silencer in Texas?
Yes. Texas Parks and Wildlife's means-and-methods rules say suppressors ("silencers") may be used to take any wildlife resource, as long as all federal, state and local laws are followed. That makes Texas a popular state for suppressed hog and predator hunting.
What Texas buyers should know
Texas does not tie suppressor possession to federal registration in its weapons statute, so the walk-out option (Form 4473 + NICS) is available here under ATF's current policy. Some buyers still file a voluntary $0 Form 4 for the paper trail, especially if they travel or may move out of state.
How buying a silencer from JCM Armory works
Since October 9, 2026, ATF does not enforce Form 4 approval or registration for suppressors. At JCM you pick one of two options (full details in our How to Buy a Silencer Online guide):
- Option 1: Walk out on a Form 4473 + NICS. Fill out the 4473 at your Texas FFL, pass the background check and take it home. This relies on ATF’s current enforcement policy, which could change.
- Option 2: File a voluntary $0 Form 4 through JCM. We file the ATF Form 4 with the $0 tax option so your suppressor is registered in the National Firearms Registration and Transfer Record. You wait for ATF processing, but you have federal paperwork on file.

Texas silencer FAQ
Is a silencer legal in Texas without NFA registration?
Texas Penal Code §46.05 no longer lists silencers as prohibited weapons, so state law doesn't separately require registration. Federal policy is what changed in 2026; if you want federal paperwork on file, choose the voluntary $0 Form 4.
Can I hunt hogs and deer with a suppressor in Texas?
Yes. TPWD allows suppressors for taking any wildlife resource. Normal season, license and caliber rules still apply.
How long does it take to get a silencer in Texas?
With Option 1 you can usually pick up once it reaches your Texas FFL and you pass the background check. With Option 2, ATF's Form 4 processing time applies.
Do you ship silencers directly to my house in Texas?
No. Silencers ship to a licensed Texas dealer, and you complete the paperwork there.
