Pennsylvania: state law still references NFA registration

Pennsylvania’s protection (18 Pa.C.S. §908) is a defense based on NFA compliance that you would have to prove. Federally, a suppressor now transfers on a Form 4473 with a NICS check, with no Form 4 approval and no tax stamp (ATF policy since October 9, 2026). But because Pennsylvania law points back to the NFA, we recommend Pennsylvania buyers file the voluntary $0 Form 4 through JCM so the suppressor is registered. Ask us or your FFL before choosing the 4473-only option. Shop suppressors →

Pennsylvania has one of the biggest hunting communities in the country and a lot of suppressor owners. JCM Armory is right next door in Maryland and ships silencers to Pennsylvania FFLs.

Are silencers legal in Pennsylvania?

Yes, with a federal-law defense. 18 Pa.C.S. §908 makes it a crime to possess an "offensive weapon," which includes a "firearm specially made or specially adapted for … silent discharge." §908(b)(1) makes it a defense to prove you "complied with the National Firearms Act."

Can you hunt with a silencer in Pennsylvania?

Pennsylvania's list of unlawful hunting devices and methods (34 Pa.C.S. §2308(a)) does not include suppressors. Species, season and semiautomatic-rifle rules in the Game Code and the Hunting & Trapping Digest still apply.

What Pennsylvania buyers should know

Pennsylvania's protection is a defense based on NFA compliance that you would have to prove, so we strongly recommend the voluntary $0 Form 4 through JCM for Pennsylvania buyers. Keep your approved form with you.

How buying a silencer from JCM Armory works

Since October 9, 2026, ATF does not enforce Form 4 approval or registration for suppressors. At JCM you pick one of two options (full details in our How to Buy a Silencer Online guide):

Our recommendation for Pennsylvania: Option 2, the voluntary $0 Form 4, because Pennsylvania law ties silencer ownership to federal registration or compliance.
